With the starting point of the theoretic approaches of R. Segato and E. Dorlin, this essay’s main aim is to analyze the judicial resolution of Judge Rodolfo Mingarini that took place in June of 2021, in the province of Santa Fe. The dictate released a man accused of sexual abuse with restriction measures due to the use of prophylactic by the victimizer/acused
The events timeline and the phenomenons related to the resolution are reconstructed by means of documentary compilation, performing a discourse analysis from a Feminist and Human Rights approach.
Firstly, progress in terms of gender/s and public politics is mentioned. In the second place, relevant points of theoretical approaches such as the ones from R. Segato and E. Dorlin are introduced. Additionally, documentary reconstruction of the case is developed taking into consideration the interpretative analysis of the former approaches mentioned. In the final instance, some reflections related to consent, the State, defense and some possible futures are exposed.
