The objective of this paper is to think about the role that human rights have to play in today's world, based on an antinomy that it’s present in H. Arendt's proposal in relation to this topic. In terms of E. Balibar, this antinomy consists on the conjugation of a radical critique of the anthropological foundation (human nature does not preexist the granting of rights given by the institutions), with an inflexible defense of human rights that must be placed in the center of a democratic construction (what remains to be done when we admit that the same institutions that make human beings through the reciprocal concession of rights, are the ones that can destroy them or impede their exercise?). Through this development, we will try to probe that, behind the ambiguity of Arendt’s proposal, there is a certain conception of politics that suggests us certain ways of action at the same time that imposes new challenges on us.
